The provisions listed herein regulate the use of the Ilitia Website (hereinafter, ‘Site’) that Desarrollo de Medios y Sistemas (hereinafter, DMS) makes available to Internet users.
DMS, with registered address at Calle Hospital, 5, Pozuelo de Alarcón (Madrid) and C.I.F. [company tax code] number B84278118, is registered in the Commercial Registry of Madrid, section 8, page M-374971, volume 21122, sheet 58.
Use of the Site confers the condition of user of the Site (hereinafter, ‘User’) and implies the acceptance of all the requirements indicated in this Disclaimer. Therefore, User must read this Disclaimer carefully every time they use the Site, since it may be subject to changes or updates without prior warning.

2. Intellectual and Industrial Property

All content on the Site, including images, technology, software, links and audio-visual content, as well as its graphic design and source codes (hereinafter, ‘Content), are the intellectual property of DMS. Trademarks, trade names or logos are the property of DMS or third parties, and use of the Site cannot be understood to grant any rights over the same.

3. General Conditions of Use of the Site

The User is obliged to the use the Site correctly and honestly in accordance with the Law and this Disclaimer. Users shall be liable to DMS or to third parties for any damage that may be caused as a result of their failure to comply, or for use of the Site for purposes that could harm the interests of DMS or third parties, or in any other way that causes damage to the hardware or software of DMS or third parties.

3.1 Content

The User undertakes to use the content in accordance with the Law and this Disclaimer, as well as any other conditions and regulations that may be applicable in accordance with the previous paragraph.
The following, amongst other things, are expressly prohibited under current legislation:

Distributing, reproducing, copying, making available, communicating publicly or changing the Content except as permitted by law or with the express consent of DMS.

3.2 Links to the Site

Internet Users who wish to include links from their own Websites to the Site must meet the requirements set out below. Ignorance does not, under any circumstances, release the individual from potential liabilities:

  • The link shall connect only to the homepage of the Site, which shall not, under any circumstances, be reproduced.
  • The page bearing the link shall not make any type of false, inaccurate or incorrect statement about the application Ilitia. It shall in any case be prohibited, in accordance with the applicable legislation in force at any given time, to establish frameworks that allow the Content to be displayed on websites other than the Site and, in any case, when they are displayed along with third party content that may cause confusion for users as to the true origin of the Content or serve to take advantage of the reputation of the trademark and prestige of DMS.
  • The use of trademarks or logos of the application Ilitia on the page bearing the link is prohibited except in cases permitted by law or with the express authorisation of DMS.

4. Exemption from Liability

4.1 Quality and availability of the Service

DMS shall not be liable for any damage caused to the computer equipment of Users or third parties during the provision of service of the Site.
DMS shall not be liable for any damage of any kind caused to the User resulting from failures or temporary or continuous disconnections in the telecommunications networks leading to a suspension, cancellation or interruption of the service of the Site during or prior to provision of the same.

5. Personal Data Protection

The User guarantees the authenticity of all data provided. In any case, only the User shall be liable for false, inaccurate or incorrect statements made and the damage caused to DMS or to third parties by the information provided.
Access to the Site implies no obligation on the part of DMS to check the truthfulness, accuracy, suitability and timeliness of the information supplied through the same.
Data collected through the data collection forms on the Site shall be incorporated into an automated personal data file which is the responsibility of DMS and shall be treated as confidential. In addition, DMS shall cancel, delete and/or block data that is inaccurate, incomplete or no longer necessary for its purposes, in accordance with data protection legislation.
By clicking the ‘send’ button on the relevant form, Users expressly consent to their data being used to send commercial communications by email or by any other means. Users may revoke the consent given and exercise their rights of access, rectification, cancellation and opposition by writing to the address provided in the Contact Us section.
DMS meets the security levels required by the Security Measures approved by Royal Decree 1720/2007, of 21 December, approving the implementing Regulation of Organic Law 15/1999, of 13 December, on the Protection of Personal Data. Notwithstanding the foregoing, technical security over a medium such as the Internet is not impregnable and there may be leaks due to wilful acts by third parties.
